DRAFT FOR LAWYER REVIEW — NOT LEGAL ADVICE. This document has not been approved by a lawyer and does not by itself protect the operator or anyone else.

Refund and Credit Policy

This draft explains how Sparks work, when they are and are not charged, and how refunds of real-money purchases are intended to work if purchases are ever activated. The operator is [OPERATOR LEGAL ENTITY NOT CONFIGURED]. Contact: [LEGAL CONTACT NOT CONFIGURED]. Text marked [LEGAL REVIEW] must be confirmed by the operator's lawyer.

Live purchases are switched off. No real money can currently be spent on RIFTYARD. Sections 6 to 8 describe a proposed policy for when the operator activates purchases after review.

1. What Sparks are

Sparks are platform credits. You spend them to generate a game project or to edit one with AI.

Sparks are:

  • non-transferable — they cannot be sent, gifted, sold or traded to another user or account;
  • not redeemable for cash — subject to section 8, they cannot be exchanged for money;
  • not cryptocurrency and not a token on any blockchain;
  • not interest-bearing and not a stored-value account, deposit or investment;
  • never convertible into creator earnings — whether you received them free or bought them;
  • usable only on RIFTYARD, only for generation and editing.

Points earned inside a match (for example to buy weapon upgrades in that match) are gameplay only. They are not Sparks and have no value outside that match.

[LEGAL REVIEW] Characterisation of purchased Sparks under Australian law, including the Australian Consumer Law, any gift-card or stored-value rules, and financial services regulation; whether Sparks may expire and on what notice. This draft sets no expiry.

2. How you get Sparks

  • Welcome allowance. A new account receives a one-off allowance when onboarding is completed. It is granted once per account.
  • Top-ups. Optional purchases of additional Sparks, if and when live purchases are activated.

Proposed demonstration settings (configurable, not validated economics, and not a promise): 100 welcome Sparks; an estimated 25 Sparks for a supported base generation; an estimated 5 Sparks for a small edit; up to three active draft projects. Playing games does not cost Sparks.

Free access is subject to fair-use and capacity limits. It does not mean unlimited generation, storage or server time. If the service is at capacity, generation may be queued or paused, and we will say so.

3. How a charge works

  1. Estimate. Before you confirm a generation or edit, you are shown the estimated cost in Sparks.
  2. Quoted ceiling. The quote is a ceiling. The job cannot charge more than the quote. If more would be needed, the job stops and asks for your approval of a new quote.
  3. Reservation. When you confirm, the quoted amount is reserved from your balance. Reserved Sparks cannot be spent twice.
  4. Outcome. When the job ends, the reservation is either settled (charged, up to the quote) or released (returned), exactly once.

Every grant, reservation, charge and release appears in your Sparks statement.

4. When you are not charged

You are not charged, and any reservation is released in full, when:

  • the request is rejected at preflight — for example it is invalid, breaches the Community Standards, asks for something the platform does not support, or exceeds a limit;
  • the AI provider or the platform fails — for example an outage, timeout, internal error or a job abandoned by the system;
  • the build fails and is unusable — the job could not produce a project that passes validation and the automated checks, including after the limited number of automatic repair attempts.

In each case your last working version is kept as it was.

The automated checks confirm that a result is valid and runs. They do not judge whether you like it. A valid, working result that is not what you hoped for is a completed job and is charged; you can undo it, roll back or try a different prompt.

5. Cancelling

  • If you cancel before a usable result exists, the reservation is released and you are not charged.
  • If you cancel after a usable result has been produced, the operator may apply a disclosed, bounded charge. That charge is a configurable setting and is currently set to 0 Sparks (disabled). If it is ever enabled, the amount will be shown before you confirm a job.

6. If something goes wrong with Sparks

If you believe you were charged incorrectly, contact [LEGAL CONTACT NOT CONFIGURED] with the job identifier shown in Studio. Where we confirm an error, we will correct it with a reversing entry in your statement, so the history remains visible.

7. Refunds of Spark top-ups (proposed — purchases not active)

  • A top-up is credited only after the payment provider confirms the payment through a verified event. A redirect back to the site is not confirmation. If your payment succeeded but Sparks have not appeared, they should arrive when the confirmation does; contact us if they do not.
  • Each payment grants its Sparks once, even if the provider sends the same confirmation more than once.
  • If a top-up is refunded or reversed through a payment dispute, the corresponding Sparks are removed with a reversing entry. If some have already been spent, your balance may be reduced to reflect that. [LEGAL REVIEW] Whether a Sparks balance may go negative and the consequences.
  • Change-of-mind refunds for unused purchased Sparks: [TO BE DECIDED ON LEGAL ADVICE].
  • Time limits for refund requests: [CONFIGURABLE — TO BE SET PER JURISDICTION ON LEGAL ADVICE].

8. Your statutory rights

Nothing in this policy excludes, restricts or modifies any right or remedy you have under a law that cannot lawfully be excluded. Under the Australian Consumer Law, goods and services supplied to consumers come with guarantees that cannot be excluded, and you may be entitled to a remedy, which can include a refund, if a guarantee is not met.

Statements above that Sparks are "not redeemable for cash" describe how the product ordinarily works. They do not limit any refund the law requires.

[LEGAL REVIEW] How the consumer guarantees apply to free Sparks, purchased Sparks and AI generation as a service; the mandatory wording, if any, that must accompany this policy; the position for users outside Australia.

9. Refunds of creator support purchases (proposed — purchases not active)

  • A support purchase is optional and gives no gameplay advantage, so there is nothing in the game to "return".
  • Refund requests are made to [LEGAL CONTACT NOT CONFIGURED]. Who decides and funds a refund depends on the payment model, which is not yet settled; see the Monetisation Terms.
  • When a support purchase is refunded or disputed, the creator's related earnings are reversed.
  • Unauthorised or fraudulent purchases should be reported to us and to your card issuer.

10. If the beta ends or your account closes

  • If you delete your account, unused free Sparks are forfeited.
  • Treatment of unused purchased Sparks on account deletion, account termination, or closure of the service: [TO BE DECIDED ON LEGAL ADVICE].

11. Changes

Costs, allowances and limits are configurable and may change during the beta. A change does not alter the quote for a job you have already confirmed.
