DRAFT FOR LAWYER REVIEW — NOT LEGAL ADVICE. This document has not been approved by a lawyer and does not by itself protect the operator or anyone else.

Terms of Service

These terms describe the proposed agreement between you and the operator of RIFTYARD. Text marked [LEGAL REVIEW] identifies a point the operator's lawyer must confirm, change or remove before these terms are relied on. "RIFTYARD" is a provisional working name; no trade mark clearance is claimed.

1. Who operates RIFTYARD

RIFTYARD is intended to be operated by [OPERATOR LEGAL ENTITY NOT CONFIGURED], of [OPERATOR ADDRESS NOT CONFIGURED] ("the operator", "we", "us").

Legal notices: [LEGAL CONTACT NOT CONFIGURED]. Copyright and trade mark complaints: [COPYRIGHT CONTACT NOT CONFIGURED].

Until those details are configured, the service is a private test environment and these terms are a draft only.

2. What RIFTYARD is

RIFTYARD is a browser platform where people can:

  • play games in the browser, alone or with others through a share link;
  • describe a game and have an AI system assemble a game project from supported building blocks;
  • submit a version of a game for publication, subject to human review;
  • remix another creator's published game, but only where that creator has permitted it.

Games on RIFTYARD are structured data (a "RiftSpec") interpreted by the platform's own runtime. Creators do not upload executable code in this beta.

3. Invite-only, adults-only beta

RIFTYARD is an invite-only beta for people aged 18 or over.

  • You need a valid invite to register, unless the operator has opened registration.
  • You must confirm that you are 18 or older. If you are under 18 you must not use the service.
  • A self-declaration of age is not robust age verification. We record only the fact and method of your declaration, not your date of birth. We may introduce a stronger age-assurance step and require you to complete it to keep using some or all features.
  • Guest play, where it is offered, is available only through an invitation from an account holder and does not bypass the age or access requirements of the beta.
  • A beta can change, break, lose data or end. Features described in these terms may be unavailable, incomplete or switched off.

[LEGAL REVIEW] Age requirements, the adequacy of any age-assurance method, and the effect of Australian online safety law on this service must be assessed by the operator's lawyer. Labelling the service "18+" does not remove any legal duty.

4. Your account

  • You must give a working email address and choose a unique handle.
  • You are responsible for activity on your account and for keeping your sign-in details secure.
  • One person, one account, unless we agree otherwise. Do not share, sell or transfer an account.
  • A verified account is required to generate, publish, buy anything, or onboard as a creator.
  • You can ask to export or delete your account data. See the Privacy Policy.

5. Acceptance and changes

We record your acceptance of each document that requires it, together with the document version, a hash of its exact text, the time and your account. If we make a material change, we will ask you to accept the new version before you continue to use the affected features.

[LEGAL REVIEW] What counts as a material change, the notice period, and whether continued use can ever amount to acceptance.

6. Rules of use

You must follow the Community Standards. In summary, you must not:

  • break the law or help others to do so;
  • upload, generate, publish or share content you do not have the right to use;
  • harass, threaten, dox or abuse other people;
  • attempt to cheat, tamper with rooms, forge results, or interfere with other players;
  • probe, attack, overload or attempt to bypass the security or limits of the service;
  • use the service to rip, copy or redistribute assets from commercial games, bypass technical protection measures, evade a takedown or re-post removed content;
  • use automated means to create accounts, generate content at scale or inflate activity.

7. Content you create

You keep your rights. We do not claim ownership of what you create.

We do not claim that AI output is protected by copyright, or that anyone owns it. Whether and to what extent AI-assisted work attracts copyright depends on the law of each country and on what you contributed. We make no promise that your creation is original, protectable or free of third-party claims.

To operate the service you grant the operator the limited licences set out in the Creator Agreement — in short, the permissions needed to host, deliver and promote your content on RIFTYARD. Other users get permission to play a published game. They get permission to remix it, to monetise a derivative of it, or to export its assets only if you have separately and explicitly switched each of those on. All are off by default.

Publication is not automatic. Every version is reviewed by a human moderator before it becomes public, and a published version cannot be edited afterwards; changes require a new version.

8. Content on the service that is not yours

Games are created by users. Except for content clearly marked as coming from a platform demo creator, we do not write them and we do not endorse them. Human review before publication reduces risk; it is not a guarantee that a game is lawful, safe, accurate or non-infringing.

[LEGAL REVIEW] Content that the operator itself generates, curates, features or promotes (including seed games and editorial picks) needs separate legal analysis. It must not be assumed that any protection available to a host of third-party content applies to those activities.

9. Sparks and purchases

"Sparks" are platform credits used for generation and editing. They are not money, not cryptocurrency, not transferable, not redeemable for cash and never convertible into creator earnings. Details are in the Refund and Credit Policy.

Real-money features (Spark top-ups, optional creator support purchases, creator payouts) are disabled until the operator explicitly activates them after legal and payment-provider review. Until then, anything resembling a purchase in the product is a test fixture and is labelled as such. See the Monetisation Terms.

10. Reports, removals and suspension

You can report games, profiles and rooms, and block other users. We may remove or restrict content, close rooms, or suspend accounts where we reasonably believe these terms, the Community Standards or the law have been breached, or where we receive a rights complaint. We will tell you what we did and how to appeal unless the law or the safety of others prevents it. Processes are described in the Community Standards and the Copyright and Trademark Complaints policy.

11. Your consumer rights

Nothing in these terms excludes, restricts or modifies any right or remedy you have under a law that cannot lawfully be excluded, including the consumer guarantees under the Australian Consumer Law where they apply to you.

[LEGAL REVIEW] The whole of sections 11 to 13 must be drafted by the operator's lawyer. In particular: how the Australian Consumer Law (including the consumer guarantees and the unfair contract terms regime) applies to a free beta, to Sparks and to digital content; and which limitations, if any, may lawfully be included.

12. Service provided as a beta

Subject to section 11, the service is provided as a test-stage product. We do not promise uninterrupted availability, particular latency, compatibility with every device, or that saved projects, progress and leaderboards will be preserved. Multiplayer servers are initially located in one region and latency will vary. We do not promise cheat-proof gameplay.

13. Responsibility and liability

[LEGAL REVIEW — TO BE DRAFTED BY COUNSEL] This draft deliberately contains no limitation-of-liability or indemnity wording for players. The following principles are intended and must be reflected accurately:

  • accepting these terms does not transfer all legal responsibility to you or to creators;
  • these terms cannot bind people who have not agreed to them, including third-party rightsholders;
  • these terms do not remove statutory rights;
  • these terms do not give the operator any automatic "safe harbour" or immunity. Whether any statutory protection is available must be assessed separately for Australia and for the United States, and for any other market.

14. Ending the agreement

You may stop using RIFTYARD and request deletion of your account at any time. We may suspend or end your access for serious or repeated breaches, to comply with the law, or if the beta ends. Sections that by their nature should survive (for example licences already granted to remixers, and records we must keep) continue after termination.

15. Governing law and disputes

[LEGAL REVIEW — TO BE DRAFTED BY COUNSEL] Governing law, courts, and any dispute process are to be decided once the operator entity and its State or Territory are known. Nothing here is intended to limit rights you have under the law of the place where you live that cannot lawfully be excluded.

16. Availability outside Australia

The beta is designed for an Australian operator and an Australian-hosted service. It is not offered as a worldwide launch. Each additional market requires its own legal review before the service is promoted there.
